Terms of Service

These Terms of Service ("Terms") govern your use of the Healthy iOS and macOS application and the supporting website at healthy.erezults.com (collectively, the "Service"). The Service is operated by Erez Cohen, a sole proprietor based in Tel Aviv, Israel ("we", "us", "developer").

By creating an account, signing in, or using the Service in any way, you ("you", "user") accept these Terms and the Privacy Policy. If you do not accept, do not use the Service.

1. Acceptance and eligibility

You must be at least 16 years old, or the minimum age of digital consent in your jurisdiction, to create an account. By creating an account you represent that you meet this requirement.

If you are using the Service on behalf of a family member, including a minor child, you represent that you have the legal authority to do so and that you take responsibility for their data and use.

2. The Service, in plain language

Healthy is a tool for personal record-keeping of health information and for sharing those records with members of a family group you invite.

The Service includes:

  • A native iOS / macOS application,
  • Cloud storage and synchronization backed by Supabase,
  • Optional AI-assisted document parsing powered by Google Gemini, called from a secure server-side function,
  • Push notifications via Apple Push Notification service.

We may add, change, or remove features over time. Material changes will be disclosed in-app or by email.

3. ⚠️ MEDICAL DISCLAIMER — please read

The Service is provided for personal record-keeping only. It is NOT a medical device, a diagnostic tool, a clinical decision-support system, or a substitute for advice, diagnosis, or treatment from a qualified healthcare professional.

  • The Service does not give medical advice. Information you enter is yours; the app stores and organizes it.
  • AI-extracted fields are not verified. Our AI document parsing returns its best guess for fields such as dates, dosages, and lab values. It can be wrong. Always check against the original document. Never rely on Healthy alone for a medication dose, an appointment date, or a clinical decision.
  • In an emergency, call your local emergency services (911 in the US, 101 in Israel, 112 in the EU). Do not use this app to manage time-critical situations.
  • Always consult a qualified doctor or pharmacist before changing medications, interpreting lab results, or acting on any health information. Healthy is a notebook, not a clinician.

If you do not accept this disclaimer, you must not use the Service.

This disclaimer follows the principles laid out in Apple's App Store Review Guidelines § 1.4 (Physical Harm) and is consistent with the medical-data guidance Apple provides for HealthKit-based apps. Healthy is not a HealthKit app today, but we apply the same caution.

4. Your account

  • You are responsible for keeping your account credentials secure.
  • You are responsible for all activity that happens under your account.
  • Sign in with Apple uses Apple's account-protection mechanisms; we never see your Apple ID password.
  • If you suspect unauthorized access, change your password immediately and email us.

5. Family groups, roles, and shared data

When you create or join a family group:

  • You agree that every member of the group can see every record in the group's shared profiles, subject to their role.
  • The group owner can promote, demote, or remove members.
  • A removed member loses access to the group's records instantly, on next sync.
  • If the owner deletes their account, the next-most-senior admin is promoted to owner automatically. If no other member exists, the group and all its records are deleted.
  • When you add data about another person (your child, parent, partner), you represent that you have the right and authority to do so, and you are responsible for that person's privacy under applicable law.

6. Acceptable use

You agree not to:

  • Upload content that is illegal, infringes someone else's rights, or is obtained without authority.
  • Use the Service to harass, threaten, or impersonate any person.
  • Attempt to reverse-engineer, decompile, or extract source from the app, except where such restriction is prohibited by law.
  • Bypass, disable, or interfere with security features — including the Row-Level Security policies, rate-limiting, or AI-input guards.
  • Use the Service to send spam, malware, or any automated traffic.
  • Resell access to the Service or build a competing product on top of our APIs.

We may suspend or terminate your account if you violate this section.

7. Subscriptions and billing

The core Service is free. Optional premium features (such as AI-assisted document parsing beyond a free monthly limit) are sold as auto-renewing subscriptions through Apple's App Store.

  • Pricing is shown inside the app before you confirm.
  • Subscriptions auto-renew until canceled.
  • Cancel at any time in iOS Settings → Apple ID → Subscriptions → Healthy. The current period continues to its expiration date.
  • All refunds are processed by Apple at reportaproblem.apple.com. We do not issue refunds directly.
  • Family Sharing of premium access is supported under Apple's standard family-sharing mechanism.

EU consumers have a 14-day right of withdrawal under Directive 2011/83/EU. If you wish to invoke it, contact Apple and us — Apple's refund process is the operative route.

8. AI-assisted document parsing

When you use AI document parsing:

  • You confirm you have the right to upload the document.
  • The document and the AI's structured output are transmitted to Google Gemini through our secure Edge Function, solely to produce a structured summary for you.
  • Per Google's current terms for the paid Gemini API, your data is not used to train Google's models. We do not opt into any training mode.
  • Output is best-effort and may contain errors. See Section 3.

You can disable AI document parsing at any time in Settings → AI Document Scan.

9. Intellectual property

  • We own the app, the website, the Healthy brand, and all related intellectual property.
  • You own the records, documents, and notes you upload. You grant us a non-exclusive, royalty-free license to host, copy, transmit, display, and process your content solely to operate the Service for you and your group.
  • This license ends when you delete the content or the account.
  • We do not claim any right to use your records for marketing, advertising, public display, or AI model training.

10. Apple's required terms

If you obtained the app through the Apple App Store, the following terms apply between you and Apple (and, where applicable, you and us):

  • The license is granted by us, not by Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support.
  • If the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
  • We — not Apple — are responsible for addressing any user claims (product liability, legal compliance, consumer protection).
  • We — not Apple — are responsible for any third-party intellectual-property claim.
  • You confirm you are not in a country subject to a US government embargo or listed on US prohibited-party lists.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Warranties

The Service is provided "as is" and "as available."

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant:

  • that the Service will be uninterrupted or error-free,
  • that AI-extracted fields will be accurate,
  • that data will never be lost (back it up via Settings → Export),
  • that the Service will meet any specific medical, clinical, or regulatory standard.

Nothing in this section limits any warranty that cannot be excluded under applicable consumer law.

12. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages — including loss of profits, loss of data, or medical injury caused by reliance on records stored in the Service — even if we were advised of the possibility.
  • Our total aggregate liability for any claim arising from or related to the Service is limited to the greater of (a) US$50, or (b) the total fees you paid us in the 12 months preceding the claim.

Nothing in this section limits liability that cannot be excluded under applicable law (gross negligence, willful misconduct, consumer protection minimums, death or personal injury caused by negligence).

13. Indemnity

You agree to indemnify and hold us harmless from any third-party claim arising from:

  • your violation of these Terms,
  • your misuse of the Service,
  • content you upload, including content about other people that you did not have the right to share,
  • your violation of any law.

14. Termination

You may stop using the Service at any time. To delete everything, use Settings → Delete account.

We may suspend or terminate your access if:

  • you breach these Terms,
  • we are required to do so by law,
  • continuing service would expose us to material legal or security risk.

We will give reasonable notice before termination unless the breach is urgent (security, illegal content).

15. Changes to these Terms

We may update these Terms. When we make material changes, we will:

  • update the "Last updated" date at the top,
  • show an in-app notice on next launch,
  • where required by law, ask you to re-accept.

Continued use after a material change means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts of Tel Aviv-Yafo, Israel have exclusive jurisdiction, except where mandatory consumer law in your country of residence grants you the right to litigate locally.

You and we waive the right to a jury trial where such waiver is permitted by law. Class actions are waived where such waiver is permitted by law.

17. Severability and entire agreement

If any provision of these Terms is held invalid, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service, and supersede all prior agreements on the subject.
